(a) Eligibility of a member already subject to a period of obligated service

Section 710 of title 10, United States Code, is amended, in subsection (a), by adding at the end the following new paragraph:

(3)

The Secretary of a military department may not prohibit a member from inactivation under this section solely on the basis that such member is subject to a period of obligated service on active duty other than a period of service under subsection (c)(3).
