(C)

In addition to the requirements under subparagraph (B), the Secretary shall waive the referral requirement in paragraph (1) in the case of a member of the armed forces serving on active duty who seeks to obtain an appointment for physical therapy provided by a licensed provider under TRICARE Prime if the provider is located in a State in which the law of that State does not require a referral for that specific appointment.
